In the claims of defective indictment, Lyons writes: Facts are missing from the indictment. It also states that with out facts, Miss Anthony can not make up and excuses! BUT they want this: The state to respond in 30 days. The defense have 10 business days to file a reply. To set a hearing date, and dismiss the defective indictment.
So looks like they are going to try and claim a technicality on the State. I am pretty darn sure that the “STATE” of Florida knows what they are doing. The d-team keeps claiming no facts were enclosed in the indictment, maybe they should let out the sealed Grand Jury transcripts so we can all be the judge of that! They are once again, grasping at straws.
In the death procedures it states that the State cannot establish that Anthony committed a capital felony that was especially heinous, atrocious or cruel. Yea, so I am wondering what is the deal with the duct tape that matches the Anthony’s duct tape? Is duct tape around her head not hateful, wicked or cruel?? Pretty cold and calculated, wouldn’t you say?
I am wondering why all these motions if they have proof that someone else put Caylee in the woods. Oh yea, putting Caylee in those woods doesn’t cover Casey from not killing Caylee. Boy, I wonder how long the Judge will deal with the defense team! As NG has said, the defense will stall, stall, stall! And they are. And I see no light at the end of this, and Justice for Caylee will take forever.
AND the pre-hearing for the fraud trial has been changed from the 18th to 11 December 2009.

That is what double jeopardy is, but she wouldn’t be tried twice for the fraud charges. There are many crimes that are all in one act and tried at the same time. They can’t try it with the murder because it wasn’t part of the murder…if it was they would have thrown them in there too. They are just idiots.
They are spinning like defense attorneys do…they spin the facts and try to spin the law to suit their client…they all do this.

Maybe not to get the dp, but since Caylee’s remains were found with duct tape around her mouth…I do believe they will be able to get a conviction with the dp at sentencing. If the defense wants to save their clients life they need to start begging for a plea.

I really think Baez convinced Casey the could win at trial…he wanted his trial. The defense probably wants a lot less than LWOP…I don’t see the state doing that they have no reason…Casey premeditated the killing of her daughter and I think the state has a great case and are saying to the defense…bite it we will take it to trial than. Just some information on the grand jury process. NO, the prosecution doesn’t have to list facts of the case, ie give all evidence. All the grand jury has to hear is whether or not there is enough evidence to proceed to trial phase, to then bring out the truth/evidence, etc. Here’s what I found:
The main purpose of the grand jury indictment process is to review the evidence provided by the prosecution and to determine whether there is enough PROBABILITY to move forward with an indictment per the provisions of the Fifth Amendment. An indictment is a formal accusation of a felony that is delivered by the grand jury proceedings after carefully considering the evidence that is presented by the prosecutor. Primarily, an indictment is in regards to a felony crime in a grand jury trial. Given the serious nature of grand jury indictments, GRAND JURY PERJURY carries similar penalties to those of perjury in any other federal or felony case. If you have a received a Grand Jury Indictment, you will need to have legal counsel represent you in your case.
