Hi Maze…I don’t know that will be the case. Today I listened to a girl tell what the accused said in court. I get really confused on which is hearsay and which is not…i am going to see if I can find that.

Theory of The Hearsay Rule
The theory of the rule excluding hearsay is that assertions made by human beings are often unreliable; such statements are often insincere, subject to flaws in memory and perception, or infected with errors in narration at the time they are given. The law therefore finds it necessary to subject this form of evidence to “scrutiny or analysis calculated to discover and expose in detail its possible weaknesses, and thus to enable the tribunal (judge or jury) to estimate it at no more than its actual value”.[3]
Three tests are calculated to expose possible weaknesses in a statement:
1. Assertions must be taken under oath
2. Assertions must be made in front of the tribunal (judge or jury)
3. Assertions must be subject to cross-examination.
Assertions not subject to these three tests are (with some exceptions) prohibited insofar as they are offered testimonially (for the truth of what they assert).

An “assertive statement” is generally defined as the intentional communication of fact. Under the Federal Rules of Evidence, an assertive statement can be oral, written, or non-verbal conduct if it was intended to be an assertion. However, any verbal or non-verbal conduct that was not intended to communicate a fact will not be considered an assertive statement.
In order for the statement to satisfy the “out-of-court declarant” element of hearsay, very simply stated, the statement must have been made outside of the courtroom that the present proceeding is taking place in — meaning that if the statement was made in another courtroom, it is still made by an “out-of-court” declarant.
Lastly, if a statement is being offered for its truth — meaning that its relevance depends upon the jury believing the substance of the statement — then it is being offered to prove the truth of the matter asserted therein. If a statement is relevant for any other purpose other than proving the truth of the matter asserted therein, then the statement will not be considered hearsay under the Federal Rules of Evidence.

Casey’s car was at the towyard from 30Jun – 15Jul08. This picture below, looks like that car is sooo clean you could see your reflection in it! WHO cleaned this car? I’m telling you, this car was ‘detailed out’ it’s amazing to me…!

That is not all they have, media is not yet reporting it but she also had poisonous liquid in the car, taken into evidence. It is item designated 241 among docs released yesterday. Testing reveals it contains pesticide ingredients and wood alcohol. So you have a toxic and deadly liquid taken from her car and another toxic deadly liquid found along with remains….let’s see defense explain that away…the info starts on page #11481 and results of it are on page 11553

“My reaction is now I understand why the state attorney is seeking the death penalty. You now have the premeditation filled in. You now have the cause of death filled in,” attorney Richard Hornsby said.
“They confirm Caylee was dead at the time Casey had the car. In fact, she was trying to conceal the car from everybody else,” Hornsby said of the so-called coffin flies found in Anthony’s car.
Hornsby said that there are now multiple reliable scientific opinions based on insects, plant growth and from the medical examiner that the remains were dumped in late June or early July — not by someone else after Anthony was locked up as her defense argues.
Hornsby said the syringe further removes reasonable doubt about how Caylee died.
“The chloroform is the smoking gun. It’s the nail in the coffin, and the duct tape supports the imposition of the death penalty,” he said.
Based on the new evidence, Hornsby said it’s time for Anthony’s defense team to strongly reconsider their all or nothing strategy.

Eyes…she wouldn’t have gotten only 10 yrs because they wouldn’t make a plea unless it included telling them where the remains were. Than what ever she told them for a plea the forensics would have to match up when they found the remains…She would have gotten a lot longer than 10 yrs but more than likely would have had a chance at parole. There isn’t any way she will now.

I listed to the radio show interview with Diane Fanning & LP today (it is posted on the previous blog).
Fanning stated that Baez’s body guard slammed her up against a cement wall as she was trying to approach him. ! geesh
Cindy was the only girl growing up & her brothers & family called her “the princess”. You can kinda see how she passed that down to casey in how she treated her & also how she always demands to get her own way.
Most of her findings & observations are like all of ours as to the family dynamics & personalities. How they let casey get away with everything & how George wants to be honest but is overpowered by cindy.
LP said that Tracy’s interview was not complete & that there is much more damning things said & he doesn’t even know exactly all of it.
He has been offered to be flown to Australia to see the play & is a good possibility that he will take them up on it & go!
He liked the book & all his peeps read it too & thought it was very well done.
He was not sure about them getting the DP, but now after imagining caylee getting shot up with the chloroform toxic injection, a good chance they will get it.
