BTW.. I saw a video of Bill Sheaffer yesterday, and he was talking about the difference between what it takes to convict on DP in Florida vs other states. That it only takes a majority vote in Florida vs unanimous in other states… I think that’s what all of the above motions are in response to.. I think Andrea Lyon is chitting bricks because she’s realized that there’s no way she’s going to convince the majority of the jury to say NO to the DP.. (Thus ruining her “perfect” record) As Sheaffer puts it, it’s a lot easier to convince one, than it is to convince the majority.. So now she’s trying to say Florida’s law is unconstitutional.. Well, it’s worked for Floridians for years hasn’t it?? Who is she to march in and tell them that it’s wrong?? BIG NUT!! *L*

So does this mean she has written the instructions for the jury correctly, or to her satisfaction? hmmmmmmmmmmm!
Katga here is what I have found:
The motions involve constitutional issues Casey’s d-team thinks will have an impact on her trial. The d-team filed papers questioning the constitutionality of Florida’s death penalty. They also want certain jury instructions deemed unconstitutional.
It is Lyons fighting to get the DP off the table and run the courts of FL to her liking. Not to mention changing the Jury rules….

On 25 November 2009 Attys. Lyon & Baez motioned the court to declare the following Florida Statutes UNCONSTITUTIONAL:
921.141 Sentence of death or life imprisonment for capital felonies; further proceedings to determine sentence.–
(5) AGGRAVATING CIRCUMSTANCES.–Aggravating circumstances shall be limited to the following:
(d) The capital felony was committed while the defendant was engaged, or was an accomplice, in the commission of, or an attempt to commit, or flight after committing or attempting to commit, any: robbery; sexual battery; aggravated child abuse; abuse of an elderly person or disabled adult resulting in great bodily harm, permanent disability, or permanent disfigurement; arson; burglary; kidnapping; aircraft piracy; or unlawful throwing, placing, or discharging of a destructive device or bomb.
(h) The capital felony was especially heinous, atrocious, or cruel.
The capital felony was a homicide and was committed in a cold, calculated, and premeditated manner without any pretense of moral or legal justification.
(l) The victim of the capital felony was a person less than 12 years of age.
(m) The victim of the capital felony was particularly vulnerable due to advanced age or disability, or because the defendant stood in a position of familial or custodial authority over the victim.

Yep, a paternity(DNA)test would be the kind of evidence that would put that matter of who was Caylee’s daddy to rest once and for all. But I doubt that information would be disclosed before the trial and possibly not even during the trial.
Many of us have been curious, but I’m not sure how knowing who Caylee’s biological father is would factor into the murder case.

First, I doubt there WAS a trust and if there was and it was set up correctly she shouldn’t have been able to touch it without approval. IF there was one I would guess that it would be able to be accessed by Caylee only when she reached a certain age, and maybe with provisions then. Of course IF there was one and if it was set up by someone who knew what they were doing. I find it hard to believe that a young baby daddy would set up a trust anyway tho.

And yes, seems most trusts are set at 18, 21 or 25 years old. Sometimes they have splits … certain amount at 18 if using for college, etc.

Hello Everyone….I do think Casey has a good idea who the daddy is she kept the guys she slept with around for a couple weeks. Plus if the news didn’t make a mistake on the fbi sealing the paternity…it must not have been too hard for them to find the dad.
Didn’t they say the trust fund was set up to take care of Caylee but then he died…so no more trust fund. Having said that…I know it is all a lie because they never did all of the things they said they did. Cindy knew when Casey talked about this trust fund there was no trust fund…they all lie together.
I also don’t believe had they known who the father was that after Jesse they would have went after anything dead or alive. If they did Cindy would have no choice but to share Caylee…there was no way she was going to share again like she did when Jesse was around.

Humble…i dont know either,MAYBE kronk did call dcasey( just cause he is the PI on the case?) lol, nanna. I procrastinate too. Several years ago I made a rule for myself. My daughter wears uniforms to school so on Thursday night before I go to be the rule is that she has to have enough uniforms clean and ironed to get her thru the entire next week. Now it’s just habit that I do that. She does have a few more uniforms probably than most kids, but it works for me and she’ll wear the ones she has now for 4 years so it works for me!

Yes, JP Chatt is the father. This has been common knowledge for quite awhile and there is no doubt about it in my opinion. It is so obvious the anthonys were in on this when you look at the phone calls. What in gods name was cindy thinking when casey told her caylee was with a ‘nanny’?? Seriously, how would casey have been able to afford or even need a nanny?
Hi ya Brad, I have no clue to who the father is, but I am sad that Caylee never got to know him. Had he got to know her, she could possibly be alive today and away from the nuts that claim her.
