Casey Anthony update 02 December 2009

By

Looks like 11 December will be a long hearing. The defense team has file 5 more motions.  One for the family jail video’s  to be destroyed.  Another is the video taping of the Attorney/client to stop.  Another is the prelude of the death penalty,  a double jeopardy clause and protective order for DCasey.

Prelude Death penalty

Attorney/Client video

Family Videotaping

Double Jeopardy clause

Protective Clause [DCasey]

I am pretty sure that we heard the “Stop Attorney/Client videotaping”, guess the first answer wasn’t good enough for them. It was not granted.  I guess we will be seeing this again, and again.  Wonder what they are looking to hide!

We have also heard the family doesn’t want to be video taped while they visit. I guess they want special privileges for Casey.  I remember hearing Casey will NOT receive any special privileges.  But I am curious to what they want to talk to her about that can’t be seen on national tv!

The double jeopardy clause is to dismiss her fraud charges.  They are claiming she is protected by the 5th and 8th amendments of the US Constitution.   I say she is guilty as charged.  And I hope they do not drop these charges.  It is not about Miss Anthony, it is about getting closure for Amy Huzienga, the victim!

The Prelude to Death penalty motion states the Prosecution does not have a legitimate interest in seeking the death penalty against Miss Anthony.  It states the prosecution cannot establish capital murder as a matter of law.  It claims insufficient evidence as a matter of law and that the state must prove aggravating factors beyond a reasonable doubt.

The protective order is for Dominic Casey. It states that the prosecution did not coordinate with the undersigned counsel about this hearing. Diana Tennis is unable to make it! Guess she should send in the big INfamous Baez….

    steph ,everybody gone alreeady??

  4. stephanie on 2 December 2009 at 18:11

You are right Humble…some of these motions are repeats. Why can’t they just go in there and act like a normal family? Hi mom and dad hi Casey…how are you holding up? Pretty simple, imo.

There are criminals all the time sitting in jail and waiting for different cases to come up…Could you see them all filing motions…it is double jeopardy. I wonder if the x of Kronks filed a motion for her charges…she also was charged with the same things, lol.

  5. stephanie on 2 December 2009 at 18:12

Only one of them said good bye Mikka so I am not sure. I think there will be more later. I know I have to go soon because of work tomorrow, but I will be on here later with evveryone tomorrow night

  8. Colhere on 2 December 2009 at 19:21

Heya.. as I look at the protective order, it is issued by D. Tennis.. Did DC give depo? I know he didn’t show up for one, right?

  9. Colhere on 2 December 2009 at 19:24

Ah.. gotcha.. I should read prior to asking..

  10. humbleopinion on 2 December 2009 at 19:41

Hi Col, He has skipped many. I had all of these darn motions open and didn’t read her name on the next page. I was sluffing!

  11. Molly on 2 December 2009 at 19:44

Obviously those video’s of casey & baez must show some improper behavior for him to want to erase them forever. It’s very clear from other footage of them that they are very familiar with each other, they are very comfortable touching each other & being close. Prolly doesn’t want his family to see them. Why else would you want them destroyed??

  12. gigwails on 2 December 2009 at 19:54

Hi folks. The D-Team will never stop, will they?

  13. humbleopinion on 2 December 2009 at 20:02

Hi ya Molly, I am sure there is something! I guess he doesn’t understand, No way Jose!

Gig, they will not! Lyons must have made some bucks off the last TV extravaganza!

  14. gigwails on 2 December 2009 at 20:24

    Hi Humble!

Hello.. If anyone is here.. I’m just here for a few minutes.. Going to bed soon.. I just got home from work, and I’m beat.. Just stopped in to see if anything new had happened, and of course the idiots are at it again.. Dismiss this, dismiss that.. Well, I say admit them all to a nut house.. The way I read it, Florida statutes states that forgery and uttering are two separate charges, (Forgery is statute 831.07, uttering is 831.09) and I suppose they were written that way with the intent that they be punished separately. Forgery of course is actually signing the name to a document, (check) that is not yours.. Uttering that instrument is the act of actually passing that instrument to another party with the intent to defraud, which is exactly what Casey did, as WE all know, but Baez and clowns can’t seem to comprehend. Can we all say Losers??

  16. Muesli on 3 December 2009 at 04:16

Good morning. Anyone awake enough yet?

  17. Muesli on 3 December 2009 at 04:29

I still don’t understand Smoke & Mirrors post yesterday about Linda Burdick not being available. For which case, the fraud or the murder? I hope this doesn’t mean more delays in the pre-hearing for Dec. 11. I would just like to see something come to a conclusion with these cases. I am so wanting to see Casey’s reaction when she is found guilty of the 13 charges of fraud. And, more than that, I want to see the proud look on George’s and Cindy’s faces when the “mother of the year” receives the guilty verdict, and becomes an instant felon. How proud they will be to have a felon in their family.

  18. Justme66 on 3 December 2009 at 04:44

Good morning Muesli.. My son has an appointment with a bone specialist this morning, so I won’t be here long.. I just can’t believe this bunch of stupid attorneys… This sickens me to no end.. The way they’re acting it seems they think Casey is Jesus and can walk on water.. She’s nothing special, same as you and I.. The only difference is, we don’t go around stealing our friends and family blind, and we don’t murder our children.. Other than that, she puts on her pants the same way we do, and needs ABSOLUTELY NO special treatment… If it were one of us, we’d have already been tried and fried.. I don’t see where she gets by with all of this crap.. it stinks to no end.. Justice for Caylee is what this is all about, just in case these nincompoops have forgotten.. GRRRRRR

  19. Muesli on 3 December 2009 at 04:48

Good morning Justme. As for justice for Caylee. Well, that seems to have been forgotten. It’s as if she never existed the way the family and the lawyers are treating this case. Poor, poor baby. Just we strangers and the prosecution are on her side. I hope that Casey and her parents live long, long, miserable, sleepless lives. LWP is what I wish for this 23 yr. old murderer.

  20. Justme66 on 3 December 2009 at 04:48

Oh.. And we don’t go around spreading ourselves like butter, for the whole town to see either.. Another big difference.. Ms. Doorknob sure did though.. Instead of taking a picture of her face for an ID, they took a picture of somewhere further south.. No one could recognize her face, but show something else and they’d say, “Oh yeah, I know her”..

  21. Muesli on 3 December 2009 at 04:49

When George told a reporter once, a while ago, that he was proud of his daughter, I wish the interviewer had the guts to ask him what about her was he so proud.

  22. Justme66 on 3 December 2009 at 04:49

Me too Muesli.. She’s not good enough to die and escape the misery.. I hope she has to live a long healthy life behind bars, with Big Bertha the Bull Dyke as her life long companion.. She deserves nothing less.. Hehehehe

  23. Muesli on 3 December 2009 at 04:50

Justme, why does your son have to go to a bone specialist? Nothing serious I hope.

  24. Justme66 on 3 December 2009 at 04:51

True that too Muesli.. If I lived that kind of life, my daddy would become an ostrich.. Only thing is, he’d KEEP his head buried in the sand.. My mother would too.. Of course, my mother and father have morals.. Something that Casey or her parents know absolutely NOTHING about..

  25. Justme66 on 3 December 2009 at 04:53

He had a 4-wheeler accident this past weekend.. Broke his collarbone completely in two, and I’m pretty sure it’s dislocated his shoulder as well.. It’s not pretty.. But he’s breathing, and that’s what matters.. He’s in some very severe pain though.. It breaks my heart..

  26. Muesli on 3 December 2009 at 04:54

I cannot imagine the blatant way Casey stole from people, knowing she would get caught. I just loved the email from Cindy to her brother stating that Casey didn’t steal a check from the grandparents. She just used their routing number. Wonder if Cindy reread her statement, or is she just so stupid not to equate that to stealing a check. I really can’t understand their mindsets.

  27. Muesli on 3 December 2009 at 04:56

Oh, ouch. Yes, I remember seeing that, but forgot it was your son. Doesn’t it just break your heart when your “baby” is in pain. I remember those days of accidents, and the initial fear when they got hurt. I’m sure the doctors will mend him, and he will be back to being a young man doing the things that give us all grey hair.

  28. Justme66 on 3 December 2009 at 04:57

Cindy is dumb as a bucket of coal.. Or a box of rocks.. She is the original spawn of satan, Casey just followed in her footsteps.. I bet she was a hellcat growing up, and probably pulled some of the same stuff.. I hope if the family has to testify that they tell the truth on her too.. I’d LMBO.. I’d love to see Cindy’s face when it happened..

  29. Muesli on 3 December 2009 at 05:00

Justme, I want to see their faces in January when the fraud verdict is read. I’ll bet they will be shocked that someone will actually make Casey pay for her crimes. After all, they are the Anthony’s.

  30. Muesli on 3 December 2009 at 05:02

Also, interesting will be if Casey makes eye contact with Amy during the trial. Wonder who will be called to testify in this case.

  31. Justme66 on 3 December 2009 at 05:04

I don’t know for sure, but I would think the cashier who took the check, whomever cashed the check at the bank, Amy I would think would for sure be called.. Maybe Grandma Shirley seeing as Casey had done this to her as well.. I’m not real sure.. Is there a witness list for this case?? :ermm:

  32. Muesli on 3 December 2009 at 05:06

I tried to read the news, but gave up. It is only about Tiger Woods, while the world falls apart. It is sickening that that takes precedence over the important news. I will never look at him again in the same way. Now when I see pictures of his face, I think evil underneath.

  33. Justme66 on 3 December 2009 at 05:06

I don’t know if anyone has posted this, but I just found it on wftv.. Bill Sheaffer’s analysis of the latest motions..

    http://www.wftv.com/video/21790288/index.html

  34. Muesli on 3 December 2009 at 05:07

I haven’t seen a witness list for the fraud trial. We’ll have to wait for our super sleuths to come on board to ask that question. Usually Smoke & Mirrors, Stephanie or Mikka have that information. I’m not sure it was ever posted.

  35. Muesli on 3 December 2009 at 05:12

Yes, I saw that this morning. I hope he is wrong about the video in the jail. If the jail cannot have complete control over their security, then that will be a blow to the system. There are so many violent criminals in the jails, they have to have some security in place. Why should Casey be given special treatment. I wonder if they do get the judge to agree to no video recording of her jailhouse visits with her parents, if her parents would actually go visit her. I seem to doubt it. I don’t think Casey wants to see her parents. It is obvious the way she totally ignores them in the courtroom. Actually, if they did visit, and Casey loses it and yells at them, the other visitors would hear that, and someone would certainly tell the media about it.

  36. Justme66 on 3 December 2009 at 05:14

Dismissing the DP is a long shot.. He doesn’t think it will happen.. Has never seen nor heard of a case where it has happened.. And if by some chance it were to happen here, it would open up a whole new can of worms in Florida.. There’d be criminals crawling out of the wood work demanding they be treated no different.. Same thing with the video taping motion.. If it were granted, the jail would become a riot scene IMO.. I know if I were in jail, and someone was getting special treatment, I’d be throwing one hell of a fit.. They’d have to restrain me to keep me from climbing the walls.. Or beating them down..

  37. Justme66 on 3 December 2009 at 05:17

If they bend the rules for a whore, A USELESS ONE at that, then they’re going to have to deal with a LOT of these criminals coming out and demanding that they want their special treatment also.. And I think Judge Stan knows this.. I just don’t see it happening.. We had a riot at a prison here in KY a couple of months ago.. It was said that it started over food.. By the time it was over, part of the prison had been burned.. It was a mess.. When you have a bunch of criminals together, it’s amazing what can happen.. And I think the Judge had better think about this before granting this motion.. I can see the riot scene happening there, if this were granted..

  38. Justme66 on 3 December 2009 at 05:23

I don’t think Casey’s parents would go see her either.. Maybe once, just to see how it goes.. But I’m like you.. I don’t think Casey wants to see them.. After all, if this thing with Kronk doesn’t work out, who do you think is next in line to be hit with that bus of hers.. I’m really suprised it wasn’t Cindy instead of Kronk.. That one really blew me away.. I didn’t expect that at all..

  39. Justme66 on 3 December 2009 at 05:25

Well I must run.. I have to go wake up son, and it takes him a bit to get ready.. He’s moving rather slow.. I’ll try to jump on after we get back from the doctors office.. It’s been nice yapping at ya this morning.. I’ll cya’ll as soon as I can.. *HUGS*

  40. Muesli on 3 December 2009 at 05:26

Justme, you are right. If Judge Strickland allows the visits to be private with no scrutiny, then it has to be that way for all of the inmates. Can you imagine the drug dealers would have a hey day. They could continue their drug business, as no one is monitoring them. Absolutely ridiculous. If the judge allows this for Casey’s visits, then we will have to all get together, all the blogs, and bombard the media and the judge and every and anyone who is involved with this to show how serious we all take this special treatment of an accused murderer.

  41. Muesli on 3 December 2009 at 05:28

Well, it’s time to take the dog out. Lucky me, I don’t have to play golf today, and maybe I’ll get some Christmas things done. I’ll check back in from time to time to see if anything is happening. Has anyone heard anything from the A’s or the Milsteads lately?

  42. Justme66 on 3 December 2009 at 05:28

Exactly Mue.. That’s why I just don’t think Judge Stan will open that can of worms.. I think he’s alot smarter than that… I guess we’ll see on the 11th.. Cya soon..

  43. Justme66 on 3 December 2009 at 05:30

Do like I did Muesli.. Build you a running kennel.. Just open the door and let them go.. Plenty of room to run, without the leash.. And you don’t have to worry about them getting away.. It’s the lazy way of doing it, but sometimes I just don’t have time for a walk everyday.. my life is a bit crazy most of the time..

  44. Justme66 on 3 December 2009 at 05:30

I’m really gone now.. I swear.. *HUGS*

    ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

As we know, the two primary witnesses for the check/fraud case are Sandi Greene – VP, Senior Investigator, Bank of America Corporate Security and Amy Jennifer Huizenga, a former friend of Casey Anthony.

Other potential witnesses maybe Delores Maldonado, Gian H Flora Tran, Lynn Aquino, Kimberly Garcia, Officer Johan Anderson, and Cynthia Anthony. These names were listed on the questionnaire proposed for the prospective jury selection process. IIRC, the “Duhfense” Team wanted to determine if any of the jurors knew these individuals.

The comment above was my response to your question about which case Linda Drane Burdick would not be available for because the notice she filed was posted under the 1st Degree Murder case # 2008-CF-015606-A-O. Unfortunately, the myorangeclerk.com web-site does not provide more details, so I drew this conclusion based on the case number it was assigned to.

  47. CASEYCANTWIN on 3 December 2009 at 16:00

Yep….Just I’m with you on that one all i have to say is SPINDY……..BENDOVAH! Casey will stick it to her also…..she hates her mother so badly! Sadly enough Casey is running out of people to pin the murder on I’m sure that SPINDY will be next!

What’s up? Waste huuuge waste. Why are they even doing this nonsense? I know there’s plenty of $$ to be made off of a dead 2 year old, but come on! Double jeapordy…seriously…double freaking jeapordy?? As if the prosecution would overlook that little detail if it were a valid complaint.

I am so weary of the defense and their barrage of BS which is not even genuine, it’s just an attempt to wear everyone down. Why in GOD’S name is this not at TRIAL yet?? Waste huuuge waste.

  49. TechMom on 3 December 2009 at 19:37

Really good post by Richard Hornsby about why the duh-fence is trying to get the fraud charges thrown out. http://blog.richardhornsby.com/2009/12/02/casey-anthony-insufficient-funds/
It comes down to “a defendant who chooses not to testify but who succeeds in getting his or her own exculpatory statements into evidence runs the risk of having those statements impeached by felony convictions””

Basically, any exculpatory statements (via 3rd parties, even!)attributed to kc in the fraud trial can admitted and used if the fraud trial goes before the murder trial. The convictions can (and will) then be presented to the murder jury to be used to weigh her credibility (even if she doesn’t take the stand).

Good stuff. Definitely worth a read!
    =)
