Well, it has been a great week for the defense team! All their motions were denied.  The Judge Strickland, today denied the DP be dropped!

The Judge writes in the document, that while the court found much of the defense counsels argument regarding death penalty law and procedures to be compelling their argument as to the states bad faith and impermissible motives cannot withstand scrutiny.  It will be left to a jury. It also states that the prosecutions brief recitation of facts supporting its decision to seek the death penalty, in this matter was also compelling and therefore sufficient.

I am very curious to what the next step will be for the d-team!  I am sure they are pretty set on getting a change of venue.  But why would they need a change of venue if they are so certain that Casey is innocent.  Just makes you wonder.  Or maybe they will start looking for a new suspect.  Who knows, but what ever they do, I am sure it will not be in good faith, especially for Caylee!   Not sure what the idea that Joy had dropping off that letter, guess no matter what she wrote, it didn’t help Casey in anyway, shape or form.  Give it up Joy!

    I didn’t think that the judge would take the DP off the table. What for? The state has what they have and Bozo wants a piece of the pie. If his client is so innocent, what would he be worried about? He wouldn’t worry that the state had anything; however, he is defending a baby killer – he will meet his maker as well.

    I think her voice is being heard loud and clear. I think also that when the jury hears all of this stuff, she will be even louder. WF has met her match, she is going down, she is not going to get away with this. Amy will also get justice come January, then WF will be a felon, facing the death penalty. That is what she gets.

    That was only 30 days of fun for herself! What is even funnier, Cindy claims not a full investigation has been done, but you can bet it was done and has been for a while! I hope they make sure there was no accident like Cindy said and that the Nanny was never at the hospital! All stuff that Cindy told LE that Casey claimed!

    I can appreciate Strickland’s diligence in his decision. Let’s face it, when you are potentially condemning someone to death, it is their right to fair scrutiny and kudos to the D team for at least ONE meaningful motion. I am glad that justice prevailed, despite a good try by Lyon and I can almost agree with her, but given circumstances, WF was not likely ignorant of the consequences of her actions prior to killing her daughter. Let the trial begin!

    Humble, Cindy claimed that it was pizza in the trunk of the car, of course she will claim that a full investigation hasn’t been done. Actually, come to think of it; I agree with her. They need to investigate her and her sidekick H* lover man.

    CT, yea they need to be investigate! I am sure we will hear it again. But like the nurse impersonator, she is no way close to a detective.

    If WF made Caylee suffer, she should suffer just as well. A tooth for a tooth. She was facing her baby girls crying eyes as every last breath of her left her body forever. She deserves to suffer the ultimate punishment. If the needle doesn’t get her, someone else in jail will.

    @humble – I certainly don’t disagree with Lyon’s argument that a DP jury might be more likely to convict, however the law in FL is pretty clear to most folks prior to them murdering a child.. Whenever someone from Canada is given the DP there, there is a huge outcry here and huge efforts to thwart it.. my beliefs are, if I as a Canuck were to go to Texas and go on a murder spree, then I deserve what I get.. I do not agree with the DP as a person, but I know not to break the law there (or anywhere for that matter)..

    Even through Cindy and George Anthony’s words on The Today Show say that they believe their daughter Casey is innocent, their body language clearly says something different. Their body language says they know their daughter is guilty of killing their granddaughter Caylee. The shoulder shrugs, hunched shoulders, bowed head, head jerks, vocal choking. uhms, pained facial expressions, lip pursing, Cindy’s closed eyes when speaking, and George’s constantly looking down, are just a few of the “tells” which say they are not telling the truth about what they really think of their daughter and her role in the murder of their granddaughter.

    Col, I understand! But I disagree when she thinks that she can come in and change the way things are run in different states. She had a good argument, long and winded, but the state had a better one. I also am all for an eye for an eye!

    @humble – I do think that the state only executes the grossly deserving, and in this case I will guess that the true details are murky enough that WF will not be put down, but will rot in jail hopefully for the rest of her life. As much as I understand an eye for an eye, I think the ultimate purpose of law is to protect society, deter crime and ensure that what the perpetrator is faced with is carried out. If it is death, then I guess it’s death.. if it isn’t, I think that society should be protected. The person most threatened by this person is her potential future offspring. If she ever goes free, she should be medically remedied from pregnancy.. (with no anasthetic of course!)

    That case could shed some light on which way he’ll go if Casey Anthony is convicted.

    In 2004, a twice convicted felon, J.J. Curtis Jacobs, stood in front of Strickland guilty of the rape and murder of a mother of three, Lalitah “Kay” Naraine.

    Her boss said nothing but death would do.

    Because of mitigating factors, including the “staggering” abuse Jacobs suffered as a child, Strickland opted against death.

    Col, Well, even with the DP still on the table, doesn’t mean she will get it! But I am to the point with all these kids missing, and being killed that the DP needs to be automatic if they are found guilty! Today with forensic the way it is, they can pretty much pinpoint the murderer. She sure does need to be spayed.

    I agree I think that she as trying to proove to her mother that she was the mom and she brought her into this world and she was going to take her out of this world.. I just can’t think of one singe reason that they can give about what she didnt report her missing for 31 days. Ive sat and tried to think about what they might say and I don’t have a clue…Bozo is always saying that they have a very good reason for why she waited…. yeah right

    On WOFL-Channel 35, Holly Bristow reported that Strickland’s ruling wasn’t a huge surprise. “Casey Anthony’s lawyers asked the judge to take the death penalty off the table,” Bristow said. “Several lawyers have told me that even though the judge ruled against the defense’s motion it was a smart move to file it. These motions lay a paper trail that can be used down the line if Casey is convicted and if the defense wants to appeal the decision.”

    I think I am really going to like Ashton… I think he has been a lot more cool,calm, and collective lately sitting there. Many times during the early hearings, he would get a disgusting look on his face and I know it would be hard listening to Baez trying to practice law, but you still have to compose yourself…. Ashton is better than that.

    Bozo and the obese team have to make some choices. If they continue the defense for Casey, the money continues to flow but they will be exposed as complete incompetents when Casey is found guilty. If they plead Casey guilty, the money will stop. What is more important for the obese team? Casey’s life or money for them?

    Ernest, Welcome! Well there has to be a plea deal on the table before anything can happen, and I don’t think the state is going to do that. Especially after all the lies that Casey has told. And the d-team won’t have hr plea, she is 100% innocent according to Baez.
