Should the state pay the costs?

6 March 2010 at 08:44
By

SSSOOOOOOO, the defense wants to be paid by the state so they can defend the brat child. According to the d-teams spokesperson, she says the defense team has incurred “extensive costs” defending the 23-year-old mother in the first-degree murder case. She would not specify a dollar figure. According to the d-team, the expenses have skyrocketed since the death penalty was put on the table, so the defense says! According to them, if Anthony is to receive a fair trial, the government needs to pay the cost of travel, serving subpoenas, hiring experts, deposing witnesses and investigating “all aspects of the case,” her team contends.

Well, I am thinking if the case has gotten to expensive and the infamous Casey can’t afford Baez, then she needs to get a court approved attorney. I also am believing that since Baez doesn’t have enough experience to be the lead attorney, he needs to move on! I hope the people of Florida start to complain. This family is living off the state, and they all need to get a life! Casey doesn’t deserve anything but a needle in the arm!

    Hi Everyone!!

Eyewitness News found out the fees for Anthony’s attorneys would not be included in what taxpayers have to pay.

Since taxpayer dollars could be involved, the judge could question Anthony’s attorneys about any possible book or movie deals that may be planned.

If Anthony does have money coming in from any such deals, she would be obligated to reimburse the county.

Good Morning Humble, Mikka and Lurkers.

If Casey gets a new attorney I don’t think it would put the trial off. Seeing how Baez hasn’t done much work and the trial is over a year away…he should have plenty of time to play catch up.

  17. humbleopinion on 6 March 2010 at 09:32

    Hi ya Steph!

I think if the Judge is smart, he will say if you can’t PAY yoyur attorney and the fees, you will have an attorney pointed for you! She should have had one from the start! She deserves NO special anything!

    Hi ya Just me!

  24. Justme66 on 6 March 2010 at 09:37

Where are my manners… BTW.. Good afternoon everyone.. I can’t stay as usual, but I just wanted to jump on for the few minutes that I do have to spare right now..

  25. stephanie on 6 March 2010 at 09:39

    Hi Justme

Mikka..the judge probably will agree with Baez. But, Baez won’t get paid the kind of money he would like to. Also the experts won’t get paid what they normally charge…not even half of what they normally charge

  26. stephanie on 6 March 2010 at 09:40

Here is the 2009 Florida Fee Schedule:

    http://www.leg.state.fl.us/Statutes/…Section%205304

This is the most Baez would be able to get.

    d) If the chief judge or designee finds that counsel has proved by competent and substantial evidence that the case required extraordinary and unusual efforts, the chief judge or designee shall order the compensation to be paid to the attorney at a percentage above the flat fee rate, depending on the extent of the unusual and extraordinary effort required. The percentage shall be only the rate necessary to ensure that the fees paid are not confiscatory under common law. The percentage may not exceed 200 percent of the established flat fee, absent a specific finding that 200 percent of the flat fee in the case would be confiscatory. If the chief judge or designee determines that 200 percent of the flat fee would be confiscatory, he or she shall order the amount of compensation using an hourly rate not to exceed $75 per hour for a noncapital case and $100 per hour for a capital case. However, the compensation calculated by using the hourly rate shall be only that amount necessary to ensure that the total fees paid are not confiscatory.

Here is the flat rate info:

    4. For capital cases represented at the trial level: $15,000. For purposes of this subparagraph, a “capital case” is any offense for which the potential sentence is death and the state has not waived seeking the death penalty.

  27. Justme66 on 6 March 2010 at 09:42

Right on Humble.. They should have forced indigency status on her right from the get go.. Physically forced it if need be… As I said last night, judging from her work history and the history of her parents, they should have known that this would happen… The A’s thought the gravy train would never leave the station though, and that Casey’s defense team would be a breeze to pay for… GOTCHA!!! We’re no fools.. Us No Life Bloggers have had enough… FED UP to the eyeballs with their horse chit.. They have never, nor will ever get one cent from my pocket… Get this trial moving.. Let her defend herself since she’s been reading those law books.. Just get justice for the REAL victim here already.. CAYLEE deserves it…

  28. Justme66 on 6 March 2010 at 09:44

Steph.. $15,000.00 won’t even pay for Bozo’s replacement underwear… You know.. The ones he’s already stained with skid marks from being so upset… WWWWAAAAAAHHHHH!!! HEY BOZO, BUY BROWN… Then you’ll be blendin’.. hehehehe

  29. Justme66 on 6 March 2010 at 09:46

OOPS.. That should have read, “to replace the ones he’s already ruined with skid marks”.. My bad!!!

  30. humbleopinion on 6 March 2010 at 09:49

Thanks Steph! Interesting, but if the state pays the attorney should be approved by the state and he is still in-experienced!

  31. stephanie on 6 March 2010 at 09:50

    Justme…So true, lol

  32. Justme66 on 6 March 2010 at 09:50

One more thing, then I have to go pick up my son from baseball practice…

Humble is right about one more thing.. It’s going to take the people of Florida to stop this fiasco… We can whine and complain all we want, but if we don’t live there, and don’t vote there, we’re all wasting our breath IMO… IF the judge agrees, declares Casey indigent, and ALLOWS her to keep her current defense team at the taxpayers expense, I think that would be the BIGGEST mistake he could ever make as far as his political career is concerned.. She has no special rights… Treat her the same as any other “Poor” murderer… Give her a public defender and tell her to shut the he11 up… IMO

  33. humbleopinion on 6 March 2010 at 09:50

Justme, like everything casey has done, she thinks she deserves the best! Today the best is the needle!

  34. Justme66 on 6 March 2010 at 09:53

Humble.. I left a link last night on one of your previous blogs.. IF what I read is correct, and I’m interpreting it correctly, Bozo doesn’t even qualify for C0-defense status.. According to Florida law, you have to have so many felony cases, so many of them have to be murder cases, etc before you can be considered qualified… Wasn’t he mainly a misdemeanor attorney before Casey??

  35. stephanie on 6 March 2010 at 09:53

It is all very odd to me because I don’t think I have ever watched a case where they claimed no money in the middle. I am sure it has happened, but no matter this case is different from all others. Plus every high profile case I have seen that was done with private attorneys…Defendants without money, from the very beginning it was pro-bono

  36. humbleopinion on 6 March 2010 at 09:54

What ever happened to the motion the state filed to see who is paying them? Also I believe they got MONEY for that little video from the AX-wife…of course for licensing fees!

  37. stephanie on 6 March 2010 at 09:54

    bb

  38. humbleopinion on 6 March 2010 at 09:55

Steph, nothing seems to amaze me in this case anymore! They want money, but I also think they need to show what the money they had, was spent on!

  39. Justme66 on 6 March 2010 at 09:56

Copied and pasted from last nights blog:

    Justme66 says:
    5 March 2010 at 17:49
Do me a favor, if anyone is here.. I found a link called, “Indigent Defense Capital Case Representation Memorandum”.. The link is here… http://www.ncsconline.org/WC/Publications/KIS_IndDefMemoPub.pdf

On page 5 of that document are Florida’s qualifications for being an attorney for someone who has been declared indigent.. From what I’m reading, and from what I know of Bozo’s previous cases, unless I’m reading it wrong, he won’t qualify to be an attorney under Florida Law if Casey is declared indigent. Even as co-counsel, there are some pretty strict guidelines.. UNLESS I’m reading it wrong.. *Crosses fingers and prays he doesn’t qualify*

Now, I really do have to run… I have 4 minutes to get to the ballfield… Love you guys.. Cya’ll ASAP.. *HUGS*

  40. humbleopinion on 6 March 2010 at 09:58

Thanks Justme~ Not just anyone can go and work for the state and get paid by the state! Bozo is not qualified!

  41. stephanie on 6 March 2010 at 10:28

Humble…Was that a closed door meeting? I think the judge felt there was nothing to worry about. I do think they will have to show where and who all the money as gone to if she is declared indigent. Also the A’s have spent well over 100, 000 of those dollars.

Justme…Thank you. I didn’t know that. He should never been in charge of this case in the first place. Even before murder charges happened. We all knew where it was going including him. He didn’t have the experience for a high profile case like this. But, he saw this as a way to shoot him to the top…it wasn’t about his client like it was supposed to be, imo.

  42. stephanie on 6 March 2010 at 10:30

Most attorneys that take on a pro-bono case really really believe in their clients either innocence or the circumstances around say the murder where in some ways justified….at least in their clients head. Like the preacher’s wife, Codey Posey and so on. The point is they believe in the just system and want to see the right thing happen for their client…Unlike Baez, he just wants the publicity, imo.

  43. stephanie on 6 March 2010 at 10:30

And to show what a genius of an attorney he is…We all know that didn’t happen, lol

  44. eastcoastdeb on 6 March 2010 at 11:42

As far as I’m concerned, this is another ploy by the defense/Anthonys for two reasons. First of all, they’ve all had their homes foreclosed on at roughly the same time and they want to play the sympathy card to the public. Secondly, if the status is denied, they can say that Casey had insufficient representation (I know, she already does) and if they grant the defense state money, anything and everything they rake in photos will be ‘under the table’ money. PIGS

  45. debwv on 6 March 2010 at 14:02

She should have stuck with a public defender from the begining! I want to know how the A’s are still getting disability! My hubby gets SS and we have to show any other money coming in the home.My father died and left everything to me,I had to show SS what money and the home & land he left me. So how are the getting away with this?!! The taxpayers in Fl. needs to step in and fight against having to pay one cent of their hard earn money on Casey & Co. !!!

  46. Carol in VA on 6 March 2010 at 14:41

Good evening bloggers for Caylee. Maybe this is the graceful exit for Baez. He can say he had to drop out due to indigent client needing court appointed atty. I think the Anthonys are keeping the boat so all of them can live on it.

  47. Hadley on 6 March 2010 at 15:25

I will never believe the Anthonys can’t pay mortgage. This is some kind of plan they have…wait and see. I imagine they have a pile of money stashed away somewhere. These people are liars, cons, and imo no better than grifters. Imagine selling your murdered grandchild’s photos! That is shameful!

If they pay for the Anthony’s defence, the state will have to pay for other indignent’s defence. That’s only fair.

I imagine Lyons has hawked her book as much as she can, and just wants to get the he!l back to Chicago!

  48. Muesli on 6 March 2010 at 16:28

I am in attack mode. Just stay away from my money. I have a lived lifetime, working for what ever I have. I don’t care who I offend, if you can’t pay your own way, tough sheet. Why not? As Casey would have said, “I am so beyond so frustrated”, well, so be I.

  49. ~LisaG~ on 6 March 2010 at 16:29

    Great poll Humble.

I don’t anyone other then Casey, should be responsible for her own defense team. Not the state, not her parents, just her.

  50. eastcoastdeb on 6 March 2010 at 16:55

I agree Muesli and Lisa. Casey has already gotten far more than she ever deserved. So far, she’s led a charmed criminal life. Hopefully the buck stops here.

  51. stephanie on 6 March 2010 at 17:15

    Hello Everyone…

Deb…I didn’t understand the disability, but from what I have been told it isn’t from the gov. It is something you buy into from your company. I would still think they need to follow the same or similar rules as the govs.

  52. stephanie on 6 March 2010 at 17:18

I agree Casey should be the only one responsible…What I don’t get is Baez or anyone from his team crying now about the money. They knew from the beginning that she didn’t have any money. Oh wait…they saw different kind of pay outs didn’t they? So know they are going to complain because those payouts have dried up and/or didn’t turn out like they liked?

  53. eastcoastdeb on 6 March 2010 at 17:25

Steph I hope someone from their companies get out with a video tape and sees how much stress they create rather than how much stress they’re under.
Bozo’s so stupid, he likely thought everyone would work pro bono.

  54. ~LisaG~ on 6 March 2010 at 17:25

I wonder if Sindy is getting AFLAC insurance? They pay in cash, how convenient for her….

Man, I hope the IRS audits this bunch!

  55. stephanie on 6 March 2010 at 17:28

East…I don’t see how they haven’t seen her all of the media circuit, I just don’t get it.

Lisa…If you see SS you might ask. SS looked into a lot and probably knows more about Cindy’s insurance than anyone.

  56. ~LisaG~ on 6 March 2010 at 17:35

Thanks Steph, I hope SS can answer that for us.

Ya know, looking at that above photo of Lyin Lyons and Bozo, Casey could be their love child…..

    :ninja:

  57. eastcoastdeb on 6 March 2010 at 17:35

I’m sure they have lots of pics stashed for ‘when’ Casey gets out. Too bad that AFLAC duck wouldn’t bite her yap off.

  58. stephanie on 6 March 2010 at 17:45

Some think that they all fell in with Cindy…I personally don’t. I think you have to have a certain corrupt way about you to go along with anything like many have.
I also think Baez saw his own thing with this case and Cindy didn’t need him to follow into step.
The old saying “birds of a feather”

  59. eastcoastdeb on 6 March 2010 at 17:50

Steph, I think cads like them attract their own kind. Who but a bunch of evil people would want anything to do with that family?

  60. stephanie on 6 March 2010 at 17:52

East…ITA. It is like that other old saying misery loves company. They are just a bunch of evil selfish people.

  61. stephanie on 6 March 2010 at 17:52

    And arrogant

  62. Marsha on 6 March 2010 at 17:58

Hi everyone. Just looking in for a few minutes. I wonder what is the longest time it has taken for a murder to go to trial?

  63. eastcoastdeb on 6 March 2010 at 17:58

I agree Steph but it still stuns me that that many corrupt people all found each other. I tend to believe there are more good than bad, but for so many disgraceful slobs to be in the same area and all be drawn together for a feast on Caylee’s grave just amazes me.

  64. eastcoastdeb on 6 March 2010 at 17:59

I wouldn’t have a clue Marsha but the way things are going, this may be the longest.

  65. stephanie on 6 March 2010 at 18:00

I don’t know how much sense that made about misery loves company, lol. My head is exploding right now. I was just using it as an example..with these people in the Casey Anthony case, it is evil corrupt people that loves/attracts evil corrupt people.

  66. stephanie on 6 March 2010 at 18:01

Hi Marsha…I hope you are feeling better. I know back home a little girl that was not reported missing for a couple years. It took much longer than this to go to trial. The father was also charged with murder.

  67. stephanie on 6 March 2010 at 18:02

Marsha…maybe not much longer, but I am thinking 4 yrs before it went to trial.

  68. Marsha on 6 March 2010 at 18:05

It just seems that most cases to to court within what…a year?

Thanks Steph. Starting to feel better but am still really weak. Hopefully I’m getting better every day!

  69. stephanie on 6 March 2010 at 18:05

I only found one and they said it takes anywhere from 1-6 yrs for a capital case to go to trial

  70. maze on 6 March 2010 at 18:06

I have read 8 yrs for the jason williams trial

  71. stephanie on 6 March 2010 at 18:09

Hi Maze…I pray that it isn’t 8 yrs. There is no reason for that.

    Marsha…make sure you rest!

so when will the judge have to decide this.?.this week maybe some info!!!

  76. stephanie on 6 March 2010 at 18:22

So is it Strickland that decides or someone else? Do we know when this decision will come down? I am sure he will now ask to look at the records of where exactly the 111+ went to, right?

  77. mikka on 6 March 2010 at 18:26

steph, stricky will make the decision! and bozo must show where the money comes from!
cma murdered caylee and than sold caylees pictures, thats an outrage!!!!

mrasha hope you feeling soon better!

  79. stephanie on 6 March 2010 at 18:27

Thank you East…lets see if I still make sense after these night time sinus meds and a couple shots, lol.

You know they can get someone in right now and still have the trial in May of 2011. With someone else it would have already happened. H*ll Casey would probably be in better shape with the courts than she is not if there was someone other than Baez.

  80. mikka on 6 March 2010 at 18:27

    grandma maze! :w00t:

  82. stephanie on 6 March 2010 at 18:29

Hi Mikka…Thank you. You are right it is an outrage. But, that is the way things work here. So many are out for the money they can get…even when it is victimizing the victim again. It really bites too.

  83. stephanie on 6 March 2010 at 18:29

  87. stephanie on 6 March 2010 at 18:33

Thank you Mikka…Have a good evening

  88. stephanie on 6 March 2010 at 18:36

Did Cindy not say one time she gave the 200,000 to Baez?

  89. eastcoastdeb on 6 March 2010 at 18:38

Yes, Steph from the CBS interview I think. I don’t believe a word of it. As Casey looks more and more guilty, Cindy will distance herself from that ‘image’. I honestly don’t think they’ve even contributed. Cindy wants it all

  90. eastcoastdeb on 6 March 2010 at 18:40

I think Strickland is d*mned if he does, and d*mned if he doesn’t. If he denies it, later on down the road, they’ll say they couldn’t mount a decent defense. If he agrees, the citizens of Florida is once again on the hook for these parasites.

  91. stephanie on 6 March 2010 at 18:44

But, don’t you think that is where the 111+ came from that Baez said he received?
I do believe Cindy wants it all…I also believe they have gotten way more than Baez. Long ago I sat down started going through old interviews…But, was picking out only interviews with pics…not like when they are stopped in the street and such. I couldn’t finish because there were so many whether with pics or Cindy just running her mouth. But, I do know there were many weeks they had 2 and sometimes 3 interviews. They were being paid about 5K a interview or technically licensing fees. Cindy made a whole lot of money on just those. I still wonder if they received money for the home tours they gave. There was 2 of those?

  92. stephanie on 6 March 2010 at 18:47

He will have to grant it, but that is also because they do with all defendants. Unless he finds something. I would like to see who all is going to stay including the high profile experts when they don’t get paid or even half of what they are used to??

  93. eastcoastdeb on 6 March 2010 at 18:49

I figure Cindy ‘allowed’ Casey to have her own photos. Some of the money garnered could have come from what Cindy thought was Casey’s share. I think when she got control of the body, she had control of everything. I could be waaaaaaaaaay off. I’m just thinking of Cindy’s manipulation while yeilding to Casey to shut her up. It seems the way they interact. Cindy basically is out to look after herself.

Consisitently over and over, Casey has actually humiliated herself with her comments, photos and behavior. She really sounds like since she was never taught to respect ANYONE, she has even less respect for herself.

I read it before Steph. It may be from her Myspace. I thought it meant something like a drug bust. LOL

Thank you East…I think there was probably many stupid things Casey looked up during the day. All of her friends worked like most people did. She drove around with Caylee imo until George left on a regular basis. I doubt she paid any attention to Caylee and probably sat on her phone and computer on a regular basis just like we saw with the evidence.

I know Steph, that child was little more than a useless appendage to Casey. Almost every photo I see of Caylee shows a child posing or faking a smile. She was not happy. I don’t care how many people say Cindy loved her, it’s bs. The only love Cindy is capable of is self-love and any extentions that represent it. If she saw a good Caylee and Casey as a good extention of herself, she offered her perverted love. It was conditional from what I’ve seen.

Hi folks….the duh-fense team is blaming the state (as usual) for Casey running out of money because of the cost of putting on a DP defense. However, if those dummies had asked for a speedy trial and not dragged this out with all the ridiculous motions, they probably wouldn’t have run outta money.

It is really sad to think about Caylee spending the day with Casey. Her mother, the woman that is supposed to love and protect her. But, instead she pushes her aside for her on selfish needs. It is really sad!

    East…Very well said…I completely agree

Hi Gigs…They are all a bunch of dumb arses.

I have to go…watching the screen is making my head hurt more. I will talk to you all tomorrow. Have a good evening.

HI Gig, I think early in the case, Bozo was showing off and trying to intimidate the state with H Lee, and LK Baden etc. We’ve heard a lot about all these experts but have seen very little from these people.

GMorning hugs Humble & Humblers ..
I know there’s a new blog but had to add something dealing with this subject!!
you all should have heard me when I saw this.. good thing I was not on here because I’d been on moderation!! omg..
    I only have this to say on the matter;
After all the high profile attorneys “money can buy”, now they ask the state to pay for her trial? “we all knew this was coming, didn’t we”?
This is like asking a complete stranger to buy you a big beautiful house or a rare antique car just because you say you want it! well, maybe not the same but it it’s about as ridiculous!
she is killer mom & doesn’t even deserve the same air we breathe!!!!!

have keyboard with turetts so making this short.. lol
missing you all but thinking of you. hugs
