Well, once again the defense team never seems to amaze me!  Now they are filing a motion about the death penalty and the state being mean!

The defense argues the prosecution chose to pursue the death penalty against their client because they knew it would break her financially.  OK, lets go back and read the last 6 words in that sentence.  “knew it would break her financially” Yep, that is what it says!  I didn’t know that Casey really had any money, except other people’s money!  She had none up until she killed her daughter.  Sounds to me any money made, should have been Caylee’s, since it was Caylee’s pictures sold.  Casey NEVER worked, she stole from her friends, she used Cindy’s credit card..how is this breaking her financially?  I am pretty sure if it was not a death penalty case, and just first degree murder, why do they think she can afford that trial?  Maybe the stalling needs to stop!

The day after the death penalty notice came out, this is what Baez said:  Casey is fully aware the DP is a possibility, and she is aware of the FORCES out to get her. And he says that the Prosecution want her to take a plea deal. He also stated that they have been AGAINST her from the beginning.  Baez says that nothing has changed in the case and he is going to keep on doing what he has been doing. He also has planned some depositions. Baez will have to step aside and take a back seat as he is not certified in court to defend capital punishment cases.

Death Penalty

I guess when you are 100% innocent, so the defense says, they know better than think their words mean anything. If the state has nothing, like the defense says, then why are they so paranoid?  Also, if there is a problem, she could have chose a public defender, than low class egotistical Baez.

    They’re stupid if they think this is going to fly. She has already been declared indigent, duh….people of FL are paying her defense even if just partially.

    Hi Humble and Humblettes, Baez got one thing correct when he says nothing has changed in this case. Nope Nothing, he took all Casey’s money made off Caylee and has not done one blooming thing with it worth a hill of beans to defend his client. why? he is too lazy. Casey soooooooooo deserves him~~ Yes, i am just sure the State just put the death penalty back on the table to break Casey financially. hahahahahaha~~ That is one of his finer dumb and dumber statements~

    I think there may be a huge smack down in Bozo’s near future. He did a hit and run filing on the Strickland recusal motion, then he goes into hiding the very week that the Big Dog is going to be handling the case.

    True too, that Casey HAD no money. Baez took the case when she was broke. Those evil forces of the SA can’t break something that is already broke ya know?? Save us from insanity Judge Perry!

    Good morning all. Just reading around. Nothing new out there. I just checked the Judicial Calendar, and it sure looks like Friday is a GO. When I checked on the actual site for the calendar and all the motions filed under this case, it still stated notice of unavailability for Jose Biaz. Does that mean he will not be there. While I was at it, I tried to look up any court dates for Mr. Biaz between 4/28/10 and 7/28/10. It comes back that there are none. Something is definitely going on regarding Mr. Biaz, and it does not involved only 11 days or so, as posted on some sites. There doesn’t seem to be anything on the court docket for Mr. Biaz from now on through July. I can check for further dates, but I would suspect it will show the same. Anybody have any more information regarding this? Smoke&Mirrors, do you have some answers for me?

    The motion mentioned by WESH has not been filed. This motion was part of the 4 motions that the defense released to media during JS debacle. The only thing the defense has filed with the court are Baez’s notice of unavailibility & today Macaluso finally filed his motion to withdraw.

    Here is the jest of three of the motions in lay terms:

    …..Impermissible Prosecution Motives – Prosecution waited until 13 April 2009 to put Death Penalty back on the table. Caylee’s remains were found on 11 December 2008. Prosecution learned during a court hearing held on 12 March 2009 how much money Casey had to spend for her defense and the Prosecution only made this a DP case in order to bankrupt Casey’s Defense Budget!

    …Protective Order with Respect to Penalty Phase Discovery – requesting the court to enter an order to protect Casey’s Defense Team from having to reveal any information relating to any potential penalty phase proceedings to the State prior to the time that she is convicted of 1st Degree Murder, should that even occur.

    …Preclude the State’s Impermissible Gender Biased…. – Society and the court system are biased against women who are accused of violent crimes. They typically blame the mother for whatever happens to their children. They also judge the mother who does not follow societal norms for being a traditional Mom. Additionally, Orange County has failed to seek the death penalty against a large number of men accused of killing children.
