I was thinking that Caylee would be about 3 3/4 years old by now.
I did not see casey acknowledge cindy on her way out today.
She did not acknowledge her on the way in. Where did you find video of her leaving Molly? WFTV videos cut the video of that short.

I think Caylee would be almost 5. I didn’t watch the hearing but saw fake tears come from WF. She cries for herself.
I would like to know who the defense is bringing in because they want the jail logs blocked all of a sudden, they spoke of one (or more) of their witnesses yesterday in sidebar & today requested not releasing names to protect their witnesses. Lyon stated as “2 witnesses have already attempted suicide”. This is very curious.
Caroly – I caught it this afternoon when insession re-ran the whole hearing.
WF walks in with a smug on her face then cries like a wussie WF.
I think the jurors will not like the way she so carefully wipes away the tears with a tissue trying so hard not to smear her makeup. She is still cleaning up five minutes after she turns the waterworks off. At one point she must have thought her tears went upward because she was wiping them off the upper lid!!!!
caroly – i noticed that too. she was wiping under her eyes way after there were no more tears. she gave the “impression” of many more tears than their really were.
I too would like to know more about these two witnesses who have attempted suicide. Oh wait, that would be George and Sindy. I get it.
The fake tears make me want to puke.
But on WESH, attorney Richard Hornsby saw “a shallow victory” for the defense in getting the state to explain the aggravating factors in seeking the death penalty. “It proves nothing, advances the case no further,” Hornsby said. “[Prosecutor] Jeff Ashton is going to consider it a waste of his time.”
Even so,defense attorney Jose Baez told WESH’s Kealing that the defense will continue pursue the matter if it doesn’t get the detail it’s seeking from the prosecution.
During a break today, Anthony was able to tell her mother twice that she loved her, Kealing reported.
WKMG shared readers’ comments on the case. Tom wrote, “The health care bill didn’t take this long.”

WFTV’s Kathi Belich said Anthony is the first mother in Orange County to face a possible death sentence for murdering her child. “And prosecutors say that’s because she’s the first mother accused of premeditated murder who cannot blame mental illness for what she’s done,” Belich added.

Lyon keeps charging the prosecution with things like gender bias, improper use of the death penalty. She would like to take depositions from the prosecutors it seems as she commented that they could not prove the improper actions without that. The improper action was to try to bankrupt the defense to get rid of Baez. Obviously Perry told her she was not going to be allowed to do that. But is this character smearing and trying to depose the prosecutors to prove they acted in bad faith not an attempt to get rid of these prosecutors? Because if they won a motion for the prosecution acting in bad faith, the next motion would be to remove them for the same reason. Just like they did to Judge Strickland.

i don’t think what the state has give to the defense is that big a deal either. i’m surprised the state never gave it to them, it sounds like something they would have to do. it is pretty obvious what the aggravated circumstances are, but now the state will spell it out for the defense. with all of those lawyers on the defense, i’m surprised they can not figure this out how the state is going to present their case.!

I was just watching a rerun of today and at the end Perry asks defense if they have anymore motions. He says he has a “Motion for either spoliation (or exfoliation or something like that)”. Anybody know what that word or motion is?

I am still watching the hearings. The discussion on insession has Midwin Charles saying the pictures of her partying while Casey was missing do not mean anything except she was partying that night. She may have been looking for her all the rest of the time. That is such BS. If that were true why would she lie and lie and lie to hinder the police from finding her?

Molly – Mikka is right about spoliation. I looked it up on line and spoliation has to do with electronic evidence only. It is the intentional, or negligent withholding or hiding or altering or destroying of electronic evidence relevant to a legal proceeding. I guess they are going to try to knock either the compter searches, the text messages or maybe even the cellphone tower hits.
Lyon better pack it up and head back to illinois to rip off some more ‘students’ with her sham teaching. I don’t think she is going to succeed for Casey. Baez will be spending the nex 3 days trying to figure out all of the arguments made today.

What is spoliation?
Spoliation, in a legal context, is any act that renders potential evidence invalid, either intentionally or through negligence. In the case of a document, for example, destroying, altering or hiding it would all be considered spoliation if the document were relevant to current litigation.
Spoliation is illegal in many countries, including the United States, and is punishable by fine and/or incarceration. Furthermore, the legal system has established through case law that when spoliation has occurred it may be inferred that the evidence was unfavorable to the responsible party. As a result, that inference may be factored into the decision of the case.
I cannot believe Ryan Smith and Brooks talking about how sincere Casey’s tears are. Ryan claims he even believes she is crying for Caylee since it is when Caylee is mentioned that she cried. I guess he forgets that all this crying over Caylee only started when Lyon came on the scene.
By the time this comes to trial she will have turned on the waterworks so many times it won’t work for her any more.

baez is going to base his whole defense on claiming spoilation, mishandling, etc. well, there’s nothing else he can do.
and much of their blathering is about the media attention, what the bloggers are saying. they KEEP bringing this up. they also are bringing these things up in themiddle of arguing their motions with the state trying to infer that the state has said these things. They know all of these comments are going to be repeated over & over in the news!!
The state did not put those pictures of casey out there! they did not comment once about her attire in them, her actions in them or any sex preferences she may have. The media has, NG, JVM & everybody else.
did the defense want to find out how the state plans on using some of these photos, is that why all of the motions? are we going to have to go thru all of these motions for every piece of evidence that the state plans on presenting? now we are going to get into this exfoliation, spoilation thing for all electronic devices data that will be brought forth in this case?

Molly – you are absolutely right about all your points. I do not think when they find themselves trying to meet Perry’s tight deadlines for disclosure and submitting motions, that Baez is going to find he has all the time in the world for all his motions. Especially the frivolous ones. He had not had deadldines until now. And he’s not getting paid any more and he cannot pay another lawyer to help him. I think that already we are seeing the effects of Lyon not getting paid – she seemed taken off guard quite a few times today on points of Florida law which I doubt would happen if she had a wealthy client. Wait until poor Bozo tries to meet these deadlines himself. I think we will even see less and less of Mason.

When Baez used the term “Spoiliation” in the above referenced motion, it had to due with the Suburban DR discovery site where Caylee’s remains were found.

Yes, Judge Strickland heard the motion. On 16 October 2009 he issued an Order of “No Action.”

Thanks smoke – for all the info but especially the video. I had forgotten that one completely. What I find amazing is that the defense is so willing to presume a body there would be Caylee when Caylee – according to the defense – was abducted somewhere else. It is true that many predators ditch the body close to the abduction site but noone has ever suggested this was a predator murder. In fact we have been assured that it was not and that the kidnapping occurred elsewhere. So why does the defense assume that this is Caylee?

I love this judge. It seems as if the defense are a little taken aback by the speed with which he rules.
I remember the hearing to determine whether the defense could be at the crime scene. The lawyer for one of the agencies responsible for the initial investigation (coroner or medical examiner I think) gave testimony that the state required this agency to do all the preliminary investigation. The judge agreed. Do you remember which agency that was?
smoke – do you think that the California judge’s finding regarding Henry Lee’s alleged spolation of evidence in the Phil Spector case would be allowed in. If yes, do you think they would bring it in?

If you look at the link Smoke and Mirrors posted at 18.10 you’ll see that the Anthony’s mortgage foreclosure hearing is on May 20, 2010. Can you believe that they haven’t paid their mortgage but they went on a cruise? Who does that?
At least we know a lot of people are not getting scammed into donating to their foundation.

Caroly….it is going to get hairy…One thing I can say is Casey’s team are doing their job, the judge is carefully being FAIR, and the prosecution is sharp as a tack!!! This trial will be equal to the OJ case and Casey is a “nobody” I think the public’s love for Caylee is overwhelming.

Yea, Smoke and mirrors is a very savvy person and well informed regarding this case. The A’s have been living for free in that house. Most likely they will rent an Apt once they get the boot. They will wait until Casey is sentenced to “death row” and move to wherever she ends up. JMHO. I don’t see C&G staying together after sentencing. I think Lee accepted a DEAL long ago. I believe he escaped prosecution by telling what he knew. I still believe Lee assisted Casey after the fact by driving her from the Amscot to the A’s home to shower, get food and then back to meet Tony. I think Casey confided in him that day.

My sons birthday is 8/4/79 and I cried every birthday and Mothers Day, actually for years every day when I gave him up for adoption to the most wonderful people I could have ever picked.
Since he and his parents found me 12 years ago I cherish his Birthdays and am going to my son and daughter in laws home in San Diego this weekend for my twin grandsons 3rd birthday and my baby grandsons 1st.
To have not been able to be with the baby I so loved makes DonnaWannaSlapCasey
