In other words, here is what the state will be providing:
AGGRAVATING CIRCUMSTANCES.–Aggravating circumstances shall be limited to the following:
(d) The capital felony was committed while the defendant was engaged, or was an accomplice, in the commission of, or an attempt to commit, aggravated child abuse.
(h) The capital felony was especially heinous, atrocious, or cruel.
(i) The capital felony was a homicide and was committed in a cold, calculated, and premeditated manner without any pretense of moral or legal justification.
(l) The victim of the capital felony was a person less than 12 years of age.
(m) The victim of the capital felony was particularly vulnerable due to advanced age or disability, or because the defendant stood in a position of familial or custodial authority over the victim.

I am pretty sure this is NOT what the defense team was looking for, but wanted the facts the prosecution has. In the court hearing on 11 May 2010: “This pretensive ignorance is getting old,” Ashton told Judge Perry referring to the defense. “[Lyon] says she can’t figure out what happened, what changed this case, that she can’t figure out from 14,000 pages of discovery what is different … for her to stand before you and say she can’t figure this out is simply incredible … should the court order us to comply, we of course will.”
Of course the woman against the death penalty can come up with anything other than Casey is a female to stop this death penalty. I guess that wasn’t a very good decision to throw in front of the Judge.

I agree Mimi, I couldn’t put a mood to it either. I was looking to see if she wrote differently when she lied or spoke of Caylee. Nothing. I don’t think that writing sad things affects her mood. It only seems to change when there was anger or what I perceived to be anger. She’d write about feeling betrayed by C and G, and later be praising them. She learned the ‘denial’ lessons very well.

Hi all, still miss talking to you all, Had to get on and add this before off to see if I can get any sleep. You all talk of the 911 calls, if you think about this Cindy has sounded so upset at other times too. Not just this one 911 call what I’m trying to say ( please forgive me its late) is C&G had that car all after noon before the tow place closed right? What time lets say 6 if that late ok. So G go’s to new job and Cindy does her best to clean the death smell out of the car right!!? Just going by what Cindy said the car smelled like right? So if she knew what that car smelled like G said death too, then why does C clean it or try to and wash Casey cloths that are in it!!? Way before Cindy go’s to pick Amy up so they can go get Casey!? Then Cindy already knows there is death in the car before she even brings Casey home with no Caylee, then Caseys tells her nanny took Caylee away! Then Cindy jumps on the phone and sounds so upset to 911 about how the car smells of death and Caylee gone and nannys got her!? Right come on get real!! Who here says just like I do Cindy knew then before that call was made Caylee is dead and Casey did it!!? I just about bet the state brings this up at trail too. But everybody here is right on the money Cindy can never take that 911 call back and not make it, like I’m sure she would do if she could. Thats why I will always say the
Ant. family might as well have helped kill little Caylee!! There is no love lost there its all about how they look to others and the money!! No wonder Casey in her mind said she could and will get away with killing Caylee, just look at how 
this family is!! Now I don;t mean sick where Casey did not know what she was doing she knows right from wrong. 
But she does not know love or how to put others like your child before yourself but only loves herself sad but true and who did she learn this from? Her dear mom and dad and for letting her get away with killing her child and helping cover up they should be in jail when this is all over too and if they are not charged with something then there is something bad wrong with the law’s we have!!

Good morning all. I’m wondering if Judge Perry is really going to send the Sheriff after those who are not willingly cooperating in the taking of depositions. Remember, that is what he said he would do. Will drink first coffee, read around the media a bit, and come back. Were George & Cindy on defense’s list? I didn’t see them. Also, do we get to read all of the depositions?

Halfspot, I couldn’t agree more. Casey had serious mental issues way before Caylee was born, the fact that her parents enabled her and did not make her face consequences led to Caylee’s demise. If that isn’t bad enough, the cover-up they have participated in is worthly of them facing charges.. IMO
I can’t help but wonder if they feel responsible in some way, and are protecting her for that reason, again more worried about themselves and their image without regard to justice for Caylee. SAD

I will not be surprised at all that the ants have the money to save their home – CBS gave it to them for the pics of their poor little grand daughter.
One thing to add about J. This person does not realize that this is a forum made up of respectful people who are here for a common goal JUSTICE FOR CAYLEE. If one of us thought that some one else murdered that child and had good reason to believe it, I believe many more of us would be on board with that theory. It isn’t so, because the truth is the truth and the facts speak the truth, so I would say that J is as welcome as anyone else to give an opinion and is also subject to being ignored just as any of us are. No disrespect…it’s just that sometimes any of us can say something that isn’t popular and nobody blasts the person but rather makes no comment. So that’s just my thoughts on the subject.

Smoke, thanks for the links to the motions. Boy, trying to read leagalise makes my head spin. It seems they repeat the same thing over and over in the same paragraph. Wish I had studied law, as was my original goal. Oh, well, life happens, and it has been a good one for me.
I am concerned about something regarding Baez getting approval for Dr. Henry Lee to be paid by JAC. Did we discuss this? Wasn’t Dr. Lee working Pro Bono or at the very least for a crate of FL Oranges?
A rough calculation of what JAC may have to pay Dr. Lee for time to complete the rest of his work, travel time to inspect and to provide testimony could be up around $7k. Since Judge Perry did not ask Baez if he had been paying Dr. Lee, did Baez get lucky or what?!
This is what bugs me:
Defense attorney Jose Baez is asking for transcripts from eight witness depositions, which could cost thousands of dollars.
Weren’t they given the transcripts? Or are these their people’s transcripts?

BUT in the end we will know exactly what the people’s money was spent on, since the d-teams thinks they are above and beyond and can hide their spending.
I have a feeling (using an Anthonyism “gut”) the Anthonys will keep their house. Somehow, the money will miraculously appear from nowhere, and it will all be settled. I can’t imagine them giving up the shrine bedroom of Caylee. Wonder if they are also keeping Casey’s bedroom as a shrine, awaiting her victorious welcome home. I’ll bet that must be their most dreaded nightmare, i.e., having Casey back in that house. Can you picture it now? Can you hear Casey yelling at her mother in front of the house to f off, as was reported at the very beginning by their neighbors. What a gal.
Another thing that bugs me is that the d-team claims the state is trying to break the d-team by having the dp out there. To funny. How can you break someone who is using blood money as their payment.

I thought the Defense Team received copies of transcripts, too. Of course, there are still several Prosecution witness transcripts that have not been released. The good news may be…. Baez’s request will make them discoverable, will it not? If so, we get to see them, too!
Just recently someone posted the conversation between NG and Dr. Lee, where, when NG asked if he (Dr. Lee) was working pro bono, Dr. Lee responded, “yes”. Based on that alone, I can’t understand how it could be justified to pay him now. I need more details. We don’t get enough inside information.
Smoke, I hope so. But I wonder whose they want?! I do wonder why the transcripts can’t be given out on disk, and they can print if they want to. I am sure there is some blood money left.

One thing I wished Judge Perry had been more demanding of the defense was why didn’t they use experts in Florida. We all know using LKB, Dr. Lee, etc., was purely a PR thing. Judge Perry must know that also. Florida has a lot of dumb people, but it also has its share of intelligent people, who are experts in their field. Dr. Gagavalia, for instance.

IMO, Dr. Lee should not be compensated by JAC! I hope someone from JAC picked up on this and is in hot pursuit of nipping it in the bud before the first invoice request is submitted.
Invoice should be returned to sender marked PAYMENT DECLINED! with a footnote… any and all future expenses for subject expert witness are heretofor DECLINED… Do not resubmit! IS THAT CLEAR?!
They don’t need to pay for expert witnesses. They have us.
We can fill them in on anything they want to know.
I am so looking forward to reading the transcript of Rick Plesea’s deposition. Hope he doesn’t cave in and disappoint us.

It was my understanding that JAC would have preferred the Defense utilize the expertise of in-state (FL) expert witnesses, but they nor the Judge can tell the Defense who to hire. There was some flexibility in the JAC guidelines to allow for out-of-state experts, with the caveat being they must accept JAC rates! Judge Perry drove that point home several times.
Smoke, the people won’t pay for flights, either! Right?

IIRC, the expert witnesses will be paid for travel at a rate of $75/hr. and they will be paid $150/hr. to perform their tasks.
Now, I’m not sure about other traveling expenses for all of the expert witnesses, but Baez and Judge Perry went into detail on this matter for Jeane Barrett, Mitigation Specialist. The spoke of compact rental car vs. upgrade (she pays the difference if upgrade to large size vehicle); Airfare at historical prices of around $240/flight to FL (not sure what she paid for locations closer to her home base, but I would think it would cost less); lodging and although not discussed meals would be covered.

Muesli, I wouldn’t get myself involved in this case as an expert witness…look what happened when one blogger thought he was an expert. He got the Judge removed from the case!

You want change? Actually, it is more than 12 miles to the courthouse for me. I would like to always go, but it is a long trip, plus I’m not sure I want to be in the presence of certain people. They might have something catchy.
Question. We always seem to be able to read any transcripts that are released under the Sunshine laws. Why must the state pay for the defense to get copies? Why can’t they download them like we do?
Also, Humble, I am terrified of guns. Remember that case a year or 2 ago, where 5 people were killed in a courtroom, by someone who smuggled a gun into the courtroom? Scary.

Muesli, good question about the copies. But the d-team has used the people’s money many times already, leaving the cd at the LE office, court hearing, the felony investigation, etc. Guess they do as they please. BUT I am all for the d-team getting a cd and printing if need be.

Okay, I’ve checked the names on the Defense Witness List a couple of times now and I think I may be seeing double or triple in some cases. WTH?!
Is there no limit on the number of times the Defense can depose a witness or were some of the previous meetings Baez had with some of these witnesses just a social chat?!

I have a feeling they thought she was going to get off and out of jail for some sicko excuse they have tried to throw out there. I bet they have never been deposed by the d-team. I also bet that none of the people on that list got any notification about the deposes. Remember the defense is half common sense.
