    YW! If anyone understands the foreclosure process, please explain what is involved in the “Pre-Foreclosure” versus the actual full Foreclosure phase. And oh, if it’s not asking too much it would be nice if some of our FL friends who live in the greater Orlando area could pass by the Ant home this weekend to see if there is a sign in the yard. :smile: I just have this thing about confirmation required.

    Once the property enters pre-foreclosure, there are a number of ways the homeowner can avoid having their property foreclosed on and sold by the lender.

    1.Pay Off The Default

    If the homeowner can find the money t pay off the default amount, then the property is removed from pre-foreclosure. If the amount in default is small, and the default was caused by a temporary glitch in circumstances, then it may be worthwhile taking out a personal loan to repay the debt. If the problem is ongoing, however, this may just cause more problems for the homeowner.

    2.Sell The House

    This is a little more drastic, but is probably the best solution if meeting the repayments is likely to be an ongoing problem. By selling the house, the homeowner should be able to get a reasonable price for it. If the homeowner waits and lets the lender sell it, the sale price is almost certainly going to be much lower, because the lender just wants to offload the property as fast as possible.

    The house is mortgaged for a bit more than it is worth. They can likely sell it for no money down, taking the existing financing scheme (I don’t know how easy financing / title transfers in the US, I am in Canada). In the same position, it would be relatively easy to off a house like that here (that being said, the economy here is a lot more robust than in the US). The fact they have not even tried listing it just screams the fact that they are lazy and apathetic. Pay or sell.. $hit or get off the pot.

    Mikka, TY for the information on Pre-forecloure & Foreclosure. So, if I understand this correctly, the home Pre-foreclosure status is such that if the Ants can come up with the $128k prior to entering the Foreclosure phase, they may still get to keep their house, no?

    Wonder if they will try to get an advance on a potential book/movie deal or if they still have assets to market to media companies, such as, ABC, CBS or maybe even the NE or the Globe.

    I think they still may be able to pull a rabbit out of the hat. Maybe even have the foundation buy it. It’s going to be very interesting to see what happens next on this front. As we’ve said many times before, there is a plan. We just don’t know what it is yet.

    @smoke – I can only guess that they have been waiting on the advance book / script deal and it likely hasn’t materialized or they gambled on the trial being done by now and they would be free to sell it. They just let it go in anticipation of their big payday.

    As a network / publisher, I would be hard pressed to pay exclusivity on a story that may have legal strings attached to it that have not been addressed.. That and getting ‘in bed’ with this bunch based on a future deal would employ some amount of risk.

    The house should be torn down and razed. Who in their right mind would want that house where a baby was murdered and one that housed a killer?

    It will be forever known as the Anthony house of horrors. I thought I read somewhere that a realator has to disclose it to the buyer if someone died in that home. I wonder if they have to reveal that a murderer lived there? As if…….no one would know that. They need to do what they did to Jeffrey Dahmer and John Wayne Gaceys house…..tear it down.

    My goodness, there mortgage was only $650.00 a month, and they refused to pay that? You can’t even find an apartment for the low low price these days, yet alone house payments.

    It’s all good, just as long as they had money to put in WF’s snack attack fund, take cruises, buy diamond earrings and tattoo’s.

I think in most states you can also pay the back payments with all the interest, and all other fees will not be cheap!! If they can do this in Fl.? much cheaper to have made the payments! They I’m sure will try and pull the feel sorry for us deal!! After all, they needed the money that should of gone to paying their mortgage, for cruises, tattoo’s, jewelry, crab puffs and gas for that luxury speed boat.     The hub has been home all week and has finally cut me free from work details and slave bondage helping him. Ugh. Thank God he is going back to work Monday! With all the outside painting he was asking me what is for lunch three hours after breakfast! :shocked: I told him beer. My favorite part was when the dog stepped in the paint puddle!! :lol:
    So, how can the Ants afford rent where they moved to? Is that the pastor’s house? Maybe it is free, since they are professional free loaders anyway, the bastards.

    It’s still in pre-foreclosure.

    Nothing has changed. Their home is not on the market.

    The pre-foreclosure listings like the one provided on Yahoo are exact copies of county property records, which are available to the plublic.

Had they not felt they needed to live off the state and and had gone back to work, they wouldn’t be in this. Everything that happens to them, they bring on themselves. Remember the cruise?     If there really is a book deal in the making, the company better make sure that it is truth and not lies. There is a big difference between Cindy’s truth and the truth. Sorry to tell them, I am one who will not buy their fictional book.

    Batwoman ~ the rumor that the Ants are no longer living in the Hopespring DR home has not been CONFIRMED. Several bloggers over the past few months have made reference to the Ants possibly living in a home on Flatwood LN, but that has not bee CONFIRMED either.

    However, we do have some information that may connect to the Flatwood LN area. I’ll go get it. BBIAB

    I don’t know enough about how the foreclosure process works to make the connection between the filing of this law suit and the Pre-foreclosure listing of the property. Thank you for your comment.

  66. Here is what I found on PRE-foreclosure:

    A preforeclosure is a property whose owner has defaulted on the loan payments and whose lender has initiated the foreclosure procedure, usually starting with an official “Notice of Default” to the owner. A preforeclosure property exists during the first stage of the legal procedure, and therefore still belongs to the owner. The length of the preforeclosure period depends on type of foreclosure process mandated by state law and the applicable legal documents the borrower signed with the lender when the property was originally purchased.

  67. Lender foreclose on property:

    Lenders foreclose according to the laws in the state where the property is located. There is either a “judicial” or “non-judicial” foreclosure procedure that must be followed. States that use mortgages to document property ownership follow the judicial procedure, which requires lenders to file a court case to prove default before they can foreclose. States that use deeds of trust follow the non-judicial procedure, which does not require a court case. Non-judicial foreclosures can take as little as 30 days to complete. Judicial foreclosures can take much more time because of the need to have the court approve the foreclosure action.

    What is the Foreclosure Process?

    After the property owner has received demand for payment requests from the lender. The lender eventually chooses the option to accelerate the loan and demand that the homeowner either pay the amount due for the mortgage or give the property back (pursuant to the lien that is on the property).

    The property owner’s file will be sent to an attorney’s office who may or may not send out a final demand letter prior to filing a law suit to foreclose the mortgage.

    Once the lender decides to foreclose the property, the attorney will prepare a lawsuit for foreclosure on the lien.

    The lawsuit will be filed in the county where the property is located. Once the lawsuit is filed a subpoena will be issued for service on the owner of the property. There are other ways to achieve service, such as publication in a newspaper, but for purposes of this discussion we will assume that the property owner is staying at the property and is available for service.

    A process server, who is sometimes a deputy sheriff, will come to the property and serve papers explaining the lawsuit to the homeowner.

    The homeowner has twenty days to file an answer to the lawsuit.

    If the homeowner fails to answer the lawsuit, then the lender’s attorney can get a Clerk’s Default for Failure to Serve Papers.

    Once the lender’s attorney gets a Clerk’s Default, the lender’s attorney will present it to the Judge assigned to the case and ask for a Summary Judgment. This will include attorney’s fees, costs, and other fees spent by the lender in bringing the complaint. The Judge will then grant summary Judgment and issue a sale date, generally thirty days after the Summary Judgment.

    The property is listed in a newspaper, proof of publication is provided to the Court and the property goes to auction at the Court House steps. If the property is not bid on by any parties then the property is returned to the lender.

    If the property owner does file an answer then the answer should also include a request for mediation. Certain counties in Florida such as Seminole County, Polk County and Orange County have a mediation process whereby the property owner can sit down with the Lender, the Lender’s Attorney and any other person who has a say in the law suit. If the parties can reach an agreement then the lawsuit will either be abated or dismissed. If the parties cannot reach an agreement then the lawsuit will continue.

    Since these cases deal with money, the cases can also be moved to Federal Court if a violation of the Real Estate Settlement Procedures Act (RESPA) is found. This is an entirely separate process.

    Finally another way to stop a foreclosure is to declare Bankruptcy. If the real property is your primary residence then the Bankruptcy trustee will issue an order stopping the Foreclosure to allow the person to reorganize their debt. This is also an entirely separate process.

    The Anthonys, of Orlando, Florida, have reported their 2 beloved dogs have gone missing. They have not been seen since 3pm today, July 25, 2010. The Anthonys, have been spotted posting flyers all over town, driving around, and searching the woods on foot. They have checked with the Humane Society every 15 minutes. They say they will not give up, until their precious dogs are found. They say they cannot eat, nor sleep, with them missing. They said their worlds are shattered, and they said they cannot even imagine going on without them. If you have any information, please contact them at their current address on Flatwood Lane. Even at this very moment, George, Sindy and Lee, are trying to contact news media for coverage, regarding their missing dogs. They said as soon as they noticed at 3pm, the dogs did not come in when they were called, they searched the yard, and saw the gate open. They immediately called 911 to report their darling, precious dogs missing. George is now on his way to their pleasure speedboat, excuse me, search and rescue boat, to search the coastline, in hopes of finding Pookie and Snookie. Sindy is going door to door, with photo’s, asking neighbors, if they saw or know anything. Lee will be driving around the rest of the day, with a billboard, with photo’s of the missing dogs.

    Experts from around the world have come to examine and give their opinions of the evidence. The Anthonys’ house is in pre-forclosure, even though the monthly payment was very low. Meanwhile, George stopped depositing money in CMA’s jail acct.

    No doubt, these folks are suffering from financial mismanagement.

    Florida’s economy is severely distressed. Jobs don’t come easily to the highly employable, let alone to people like G n C. Those pennies should have been pinched until screaming. But they have done nothing but make emotionally reactive decisions with their money. This kind of budgeting existed years before a certain sick young woman pulled out the duct tape.

    Imo, the Ants have been bailing out their daughter for years and we’re seeing the logical culmination of it. Who paid for the defense experts? Who paid for the out of state fancy attorney, who went back home? Who paid for Caylee’s expenses, then turned a blind eye when CMA stole money?

    I’m sure you all already know this. I just think G n C should have cut their losses. Saving one’s daughter from death is a worthy cause, normally. But parents shouldn’t allow adult kids to take the shirts off their backs, especially when the adult kids can never reciprocate by providing care for the parents during their golden years.

    Someday, when GnC wind up lying on pressure sores in a cheap nursing home, I hope they’ll find comfort in the memory of squandering their last dollar on their death row daughter. Stupid enablers.

    Most likely.

    Houses that have horrific histories often sell pretty well, as long as it is cleaned up and smells nice. Kind of macabre, but true.

    There are buyers who want a house with some history to it. Very old houses often have death associated with them, from murders to natural causes. They do all right in the marketplace. In fact, if they were all razed, we’d have very few old and famous real estate left. Thank goodness that hasn’t happened.

    Out of that entire family, Lee seems to be the only one who is….um…sorta normal. He used his employment to move out of the family home. He tried to stay out of everyone’s business, except when push came to shove.

    Yea, it’s possible there is something much worse happening, such as incest and all. But Lee talks and acts like a person who is related to a highly dysfunctional family. Have you met close relatives of alcoholics and drug addicts? They can tell you details of an event, but have long ago given up explaining the behaviors they witnessed. They are part of the event, but have tried to distance themselves emotionally from it. They are often forced to act as go-betweens and peace keepers, which Lee was obviously roped into between Cindy and Casey.

    I wonder if there’s a support group for siblings of sociopaths? If so, Lee should join. This situation must be very frustrating for him. It’s a no win mud puddle that he can’t get away from.

    Hi folks! Hope everybody’s weekend has been good. I’m still not sure how Cindy can be on disability. How in the heck is she disabled? Emotionally? If that were the case, then how can she put her mug in front of every camera she can fiind and interject herself into the case constantly? For somebody that has “no idea” what happened to Caylee and is so “emotionally fragile,” Cindy sure has a lot to say. Physically? We’ve seen she can move around pretty nimbly when avoiding media with tough questions and she can swing a mean bat, so how physically disabled could Cindy be?. Quite frankly, she and George are a couple of con-artists and it’s no wonder Casey developed the personality she has.

    They are all emotionally disabled, but I don’t think that qualifies for disability. George and Sindy have not worked in 2 years. I guess all that money they collected through the fraudation, along with selling Caylee’s photo, and money paid for interviews has set them up pretty well. They just refuse to use any of it, on paying a pesky house mortgate :blink:

    I don’t think it would necessarily be posted on a county website. Pre-foreclosure is kind of an unofficial period where the bank is allotting a period of time for negotiations to take place before they take their final action of the actual foreclosure process (in which there is no turning back for the A’s).

    Pre-foreclosure begins with the initial court filing and notification to the homeowners, which happened on Feb 22nd/23rd. However the media found out about the court filing and notified the Anthonys first.

    There were several news stories that week, if anyone can remember. The headlines stated the same thing, that their house was being foreclosed on. That’s because the pre-foreclosure period began at that time.

    We haven’t heard much about the foreclosure so when Smoke posted it, it just seemed a site was found with the information about the house, picture,, sq. feet, etc….seems it is now just about time before they either file bankruptcy, sell the house, or get evicted.
